The Supreme Court emphasized that public safety is the priority and any religious structure encroaching on roads, water bodies or rail tracks must be removed. It stressed that India is a secular country and its orders regarding anti-encroachment drives apply to everyone regardless of religion.
The court stated, "Whether it be a temple or dargah, it has to go," during a hearing on bulldozer actions against those accused of crimes. The court clarified that only illegal constructions are being targeted.
Representing three states, Solicitor General Tushar Mehta supported the stance, and the court reiterated that any structure, religious or otherwise, obstructing public areas must be removed for public safety.
