The Supreme Court is currently reviewing the validity of Exception 2 to Section 375 of the Indian Penal Code (IPC), which deals with marital rape.
This comes after a split verdict by the Delhi High Court. Last year, the Supreme Court had requested the central government's response on the appeal against this ruling.
The government recently argued that marital rape is a social issue requiring extensive consultation, and criminalizing it could negatively impact the institution of marriage, asking the court to defer to the legislature for a final decision.
