In Pune's Kalyani Nagar on May 19 a Porsche allegedly driven by a drunk 17 year old boy fatally hit two motorbike-riding software engineers.
The boy who is the son of real estate developer Vishal Agarwal was initially granted bail by the Juvenile Justice Board (JJB) with a condition to write a 300 word essay by sparking public outrage.
Following a police review the JJB remanded him to an observation home. Authorities aim to try him as an adult supported by CCTV footage showing him drinking before the accident.
The Bombay High Court ordered his release into the custody of his paternal aunt stating the JJB's remand orders were illegal.
The court emphasized that the boy's age, under 18, must be considered highlighting that juveniles should be treated differently.
The boy is undergoing rehabilitation and is under a psychologist's care which will continue. The plea for his release was filed by his paternal aunt claiming his detention was illegal.
Additionally the police arrested his father and the bar staff for serving alcohol to a minor.
